Should You Talk to a Lawyer?

Avoid Confusion and Controversy
Write a Letter to Your Executor

While some of you have prepared your wills, many of you are thinking of either writing or updating your wills. Here are a few suggestions that may avoid confusion and controversy in the future. A “will” is a legal instrument that allows a person to dispose of his property at his death. Newspaper headlines confirm that an estate does not have to be worth a fortune for family members’ tempers to flare and emotions to run hot. A family feud doesn’t have to erupt when you are gone.

A will may bring family members together and settle unresolved disputes. The first step is appointing the right person to act as Executor. The Executor is the person responsible for executing the will: collecting the decedent’s property, paying debts, and distributing the property to the named beneficiaries. It’s best to select an Executor because he or she is a competent and well-organized person. Ideally, in addition to these “business-like” skills, the Executor should have “people skills.” The Executor will have many conversations with beneficiaries on the emotional edge. Therefore, the Executor should be compassionate and slow to anger. He should be diplomatic and a consensus builder.

Next time you are updating your will, instead of automatically selecting your oldest child as Executor, think about geographic location, diplomatic skills, and family harmony. Many children would prefer a third-party, such as an Uncle or your attorney, as Executor rather than have their pushy, know-it-all brother as sole Executor. If you don’t have a third-party, perhaps naming two family members as co-Executors is a solution. Whatever your decision, explain your choice. This can either be done in your will or you may write an informal letter outside of your will.

A letter to your Executor does not distribute your property and does not carry any legal weight. However, a letter gives you the opportunity to explain your will and to clarify your intentions. What should you include in this letter?

  1. Include why you are making the distributions in your will. This is important particularly if the distributions are unusual. This will not prevent a will contest, but it will allow people to understand how you were thinking so that your wishes may be carried out.
  2. A list of your assets and where they are located. You could save your Executor a lot of time and expense searching for your assets if you make a list.
  3. Describe your wishes about funeral or cremation arrangements, including place of burial.
  4. A list of persons to contact such as family, friends, and professional advisors – attorney, accountant and financial planner.
Give this letter to your Executor and be sure to keep a copy with your will or trust instrument. In addition, giving a copy to each of your children would probably prevent future hurt feelings and trouble. Much unpleasantness can be avoided by open communication. Trouble comes when people are upset and surprised.

Health & Nutrition Strategies For Cancer Survivors & Everybody Else Nov 2017 -- by Warren Green

WHATS IN YOUR DIET?

I've repeatedly written about food as medicine, and why. The dilemma is,the United States toxic food chain. Poor quality food results in poor health outcomes. Cancer and heart disease, the major causes of death in the U.S. are on the rise, and it correlates with the rise of poor quality/fake food. The U.S. Government asserts that the only food that qualifies for certification meet stringent standards as stated in the CFR (code of federal regulations). Standards such as: free from harmful chemicals, they will not involve genetic engineering, or bio-solids (bio-solids are a euphemism for sewage sludge from waste-water treatment operations) . On that note, I believe that many of the outbreaks of salmonella, and e-coli contaminating produce are a result of bio-solids/sewage sludge. So unless products are labeled “USDA Certified Organic” our government won't and can't attest to it's wholesomeness. In addition, as part of the global food chain, and without the rescinded “Country of Origin” labeling law, consumers are at even greater risk.

For over a year, I've been promoting our region as “The Organic Capital of the World”. The region is considered local to some of the largest farmer's markets on the east coast. We have superior transportation logistics including nearby rail service, interstate accessibility, and worldwide shipping opportunities through our neighborhood major seaport. We are within a days drive to most of the major markets, and exposure to more than sixty million customers. And, we've got the longest growing season in the region, and talented farmers.

The region has significant health disparities, and the bulk of the evidence points to the diet. A poor diet is a public health matter. Fix the diet, fix the health. Organic small acre farming is the fastest growing cottage industry in the world. Clean food is in. We should have thousands of them. Our region can be and should be, a major supplier in the organic food chain. “The Organic Capital of the World”.

This initiative should be a slam dunk. We'll explore the obstacles and resistance in next months column.

SCENE OF A CAR WRECK, Part Two -- by Danny Glover




Last month I began telling you about some very important things that you need to do (and NOT do) immediately at the scene of the wreck. They were:
  • Stay calm and breathe! If you have been injured, do not move – call 911 (if possible) and wait for EMS and then go to the hospital.
  • Once all people involved in the wreck are accounted for and that situation is stable, have someone gather all of the information possible at the scene, including the names, addresses, phone numbers and license plate numbers of any and all witnesses and other drivers involved in the wreck, and take photographs of everything. Do not rely on law enforcement to do this for you.
  • Do not move any vehicles until law enforcement arrives.
  • Do not admit fault.
Once you leave the scene, there are still some other important things that you need to do.
First, file all of your medical bills with your health insurance company. Even if the wreck was caused by someone else, your medical bills are your responsibility. Non-payment or late payment of those medical bills will hurt your credit and lead to late fees, etc. If the wreck was not your fault, you may eventually recover a settlement that includes reimbursement for your medical bills, but injury settlements take time, and it is important that you utilize all available health insurance to pay the bills as soon as possible. Some health insurance companies are entitled to repayment from your eventual settlement, and some are not. An experienced injury attorney can assist you in figuring that out as part of your case.
Second, if you are injured, do not speak to any automobile insurance company until you have spoken to an experienced, local injury attorney. Insurance companies will be trying to take your statement as soon possible, and they will typically then try to use that statement against you later to deny the claim or to try to lowball you on your settlement. A good injury attorney can make sure that you do everything necessary to make sure that you eventually obtain a complete settlement according to the law and can help you avoid making mistakes that can cost you money.
Third, if you were given a ticket, do not pay it off. Instead, speak to an experienced, local traffic attorney. Oftentimes an attorney can get your ticket reduced or dismissed and save you DMV points and possibly insurance premium increases.
Fourth, report the collision to your automobile insurance company – hopefully only after you have spoken to an attorney about your injuries or your ticket.

New Mexican Restaurant in Downtown Hertford Offers Flavorful Rotisserie Chicken & Personalized Catering -- By Laura Bush Jenkins



For award-winning restaurateur Carolina Escobar, moving from Chapel Hill to open a restaurant in Hertford wasn't something she initially expected.

When she immigrated from Mexico to California in 1986, Carolina got her start working long hours in a food truck.  While she eventually became a nutritionist and worked Monday through Friday for the State of North Carolina, she revisited several of these early experiences and opened her own food truck.  It ran on the weekends and grew in popularity as it serviced the NC State, Elon, and UNC Chapel Hill campuses.

Escobar also owned a restaurant in Chapel Hill, where she received statewide recognition for her loco burritos and deserts.  As she retired there and saw opportunity to transition into the catering aspect of the industry, a friend in the Albemarle area noticed a vacant space for rent as he was working.  He and his wife contacted the property owners and persistently called Carolina as she was in Miami, ironically leaving a church service.

Carolina laughs as she recalls how she and her husband Hector quickly changed clothes and drove up immediately to meet the owners.  They operated on little sleep, but were excited about their dream and future possibilities.

Between the lease signing and business grand opening August 19th, Hector and Carolina didn't have much time to find housing.  As they looked for places to rent, a Pepsi vendor recommended a home in Hertford walking distance from the new location, and the Escobars bought it.

The new restaurant, Taqueria Isabella, is named after Carolina's first grandchild.  You can meet "Bella" as she opens doors, washes dishes, and connects with guests and the restaurants ten or so employees.

"She keeps herself occupied and makes our lives happy," Carolina notes with a smile.

Every morning, fresh tortillas are cooked from scratch and Carolina slow-cooks fresh rotisserie chicken with a smoked taste.  This Thanksgiving season, savory rotisserie  turkey is also available for pick-up or enjoyment in house.

Open Monday through Saturday from 11-3 and 5-9, Taqueria Isabella is one of the only restaurants in Hertford serving alcohol.  As you enjoy a margarita or Mexican beer, you may notice a hand-painted mural of Morelia, Carolina's hometown outside of Puerto Vallarta.  The menu also has artwork showcasing Madero, a well-known basilica welcoming people to Morelia.

As you prepare for special events, custom catering options are available for an indoor venue or through the food truck.  These include vegan, vegetarian, and gluten-free options.  Recently, Carolina catered diverse events such as Toast the Perquimans downtown in Hertford Bay to a large wedding in Petersburg, VA at an events center.
